Article 2 – Applicability
- These general terms and conditions apply to all services, sales and communications and any offer (by post, email, website, etc.) that Private Consult provides to you. By using these services, by making a purchase or by relying on this communication, you declare your agreement with these general terms and conditions.
- To place an order or make a purchase, you must be at least 18 years old. If you are not 18, we ask you to have your parent or legal guardian place the order. If we notice that an order has been placed by a minor, we may refuse this order.
- The Private Consult website is a guide when searching for information about the products and services of Private Consult. Through this website you also have the possibility to buy products, make reservations, subscribe to electronic communication and other information.
- Private Consult reserves the right to change and/or supplement the content of the general terms and conditions at any time and for any reason without prior notice.
- If any of these terms and conditions are not legally valid for any reason, the remaining terms and conditions will remain fully applicable.
- Private Consult respects the Code of Conduct of the BeCommerce Quality Label.
Article 3 – Offer and order
Offer
- If an offer has only a limited validity period or is subject to certain conditions, this will be explicitly stated in our offer. The offer always contains sufficient information so that it is clear what your rights and obligations, linked to the acceptance of the offer, entail.
- Private Consult always describes as completely and accurately as possible what is being sold and how the ordering process will proceed. The description is in any case sufficiently detailed to make a good assessment of the product. If Private Consult uses images, these are a true representation of the products and/or services offered. Mistakes are always possible and if this has clearly happened, Private Consult is not obliged to deliver the corresponding goods.
Order on the website
- An order on the website can be placed in Dutch.
- To order a product, add the product to your shopping cart. Then enter your contact details and possibly billing details. At the end, you will be given the opportunity to create a profile. Your details will be saved and you will not have to fill in all your details again for a next order. You must pay for your order online.
- After each step you will be given the opportunity to correct any input errors. Finally, you confirm your order by pressing the order button. By confirming your order you agree to these general terms and conditions, as can be consulted on the website. Your order is final as soon as you see the confirmation page.
- We will send you a confirmation of your order by email. A link to the general terms and conditions that you can save on a durable data carrier will be added to the confirmation email. This confirmation email is considered an electronically concluded contract. No other form of the contract will be archived.
Article 4 – Right of withdrawal (cooling-off period) for distance selling
- The right of withdrawal granted to the consumer only applies if the agreement was concluded remotely (website, telephone, etc.).
- The right of withdrawal means that you have the right to decide that you do not want to keep the products and is valid for 7 days from the delivery of the product. The products may then be returned without payment of a fine and without giving a reason at the latest 7 days after notification of the withdrawal to Private Consult.
You will be responsible for the direct costs of returning the products.

- During the withdrawal period, we expect you to handle the order and packaging with care. If you still wish to return the products as described above, you may only unpack or handle them to the extent necessary to determine the nature, characteristics and functioning of the products. If you return the products, please do so in the original packaging, in the original condition and with all supplied accessories, such as manuals, warranty certificates and the like.
- Within 7 days of your notification of withdrawal to Private Consult, and provided that you have effectively returned the products (or at least provided proof of return), the full purchase price of the products will be refunded using the same payment method as you used to pay for your order.
- If you wish to exchange the product for another product, you can contact us.
- All contact details and options to contact us can be found on the website under the section “ Contact ”.
- The right of withdrawal does not apply in certain specific cases as provided for by law in art. VI 53 WER, such as for products that are liable to deteriorate or expire rapidly and products that have been personalized according to the customer's instructions.
Article 5 – Price
Our prices are in euros and include all taxes, VAT, recupel, taxes and services. Private Consult can also charge shipping costs on top of the price. This is clearly indicated before the order is final.
Article 6 – Payment
General
A purchase is only final once we have received your payment. For payment transactions with credit or debit cards, it is necessary that we have received the approval of the card issuer. If the issuer of your card refuses to agree to your payment to us, we cannot be held responsible for delays in delivery and/or non-delivery of your order. Orders without valid payment in the name of the registered cardholder will not be accepted or processed.
Online payment
- To ensure secure online payment and the security of your personal data, transaction data is encrypted with SSL technology and sent over the internet. You do not need any special software to pay with SSL. You can recognize a secure SSL connection by the "lock" in the bottom status bar of your browser.
- For online purchases we accept the following payment methods: Visa, MasterCard, Bancontact, Payconiq
Article 7 – Conformity and Warranty
- Private Consult guarantees the conformity of the consumer goods it offers as provided for in the statutory consumer guarantee.
- Any defect or fault must be reported to Private Consult within one week of its discovery. After that, any right to repair or replacement will lapse
- However, the consumer cannot invoke the legal guarantee for changes in terms or places of delivery or for defects of which he was aware at the time of purchase.

The following are excluded from the legal warranty:
• all direct or indirect damage caused to the product after delivery (e.g. by oxidation, shock, fall, etc.);
• the replacement of accessories or attachments that need to be replaced regularly;
• defects resulting from fire, water damage, lightning, accidents, natural disasters;
• defects caused by intent, negligence or by improper treatment, poor maintenance or abnormal use or the use of the product contrary to the manufacturer's instructions; - To invoke the warranty, you must be able to present the original invoice or proof of purchase. The warranty period commences at the time of delivery. The warranty can only be invoked with regard to Private Consult. In the event of intervention by a third party not designated by Private Consult, the warranty will lapse.
- For products used for non-private purposes, the restrictive warranty conditions of the manufacturer/importer apply.
Article 8 – Force Majeure
- In the event of force majeure, we are not obliged to fulfil our obligations. In that case, we can either suspend our obligations for the duration of the force majeure or terminate the agreement definitively.
- Force majeure is any circumstance beyond our will and control that prevents the fulfillment of our obligations in whole or in part. This includes, among other things, strikes, fire, business disruptions, power failures, disruptions in a (telecommunications) network or connection or used communication systems and/or the unavailability of our website at any time.
Article 9 – Liability
General
- Private Consult is not liable for errors or negligence, not even by appointees or employees, unless in the case of intent or gross negligence.
- The liability of Private Consult is always limited to direct, personally suffered damage and can never exceed the purchase price of the product.
- Private Consult is not liable for any loss or damage when using a product.
Use website
Private Consult cannot be held responsible for any damage that a web visitor may experience when visiting the website, for any malfunctions, interruptions or errors in the electronic publication of the website or for the inability to access the website.
- Private Consult makes every reasonable effort to ensure that the information entrusted to it is correct at the time of inclusion in its files, which does not prevent these files from always containing incomplete, inaccurate or outdated information.
- Sending to and from the -website any illegal material, such as threatening, defamatory, discriminatory, racist, obscene or pornographic material that violates national or international law, is prohibited.
- Private Consult reserves the right to remove data sent by users from its website if it does not correspond with the purposes of the website.
Fraudulent internet practices
Private Consult cannot be held responsible for internet fraud by third parties, such as false gift or vouchers, competitions, collections, etc. In case of doubt about actions, promotions and/or other actions under the Exclujess logo, we always advise you to contact us. All contact details and possibilities to contact us can be found on the website under the section " Contact ".
Article 10 – Intellectual property
- The information on the Exclujess website may only be downloaded for private information purposes. Any other use is prohibited.
- All texts, works, drawings, images and data as well as all names, trade names, domain names, brands, logos and other components of this website are protected by intellectual property rights that lie either with Exclujess or with suppliers or other right holders. The entire or partial presentation, reproduction, distribution, sale, distribution, publication, adaptation and use for commercial purposes in any way, as well as the electronic storage or use for illegal purposes is prohibited without the prior written consent of Exclujess, its suppliers or the rightful owners, except to identify the products or services.
- Any communication you send as a user to the Exclujess website will be considered non-confidential and non-proprietary. Hubo is not responsible for this communication.
